1. What are cookies?

3. Analytical cookies
3a. Google Analytics
For the purpose of user-oriented design and ongoing optimization, we rely on Google Analytics, a web analysis service provided by Google Inc. (“Google”). Web analytics consists in the collection and analysis of data related to visitor’s behaviours. Web analytics provides information about the previous web page from which a link was followed (the so called “referrer”) and the visited sub-pages of the web site, including the number of accesses and the time spent on the respective sub-pages. A web analysis service is primarily used for the web site optimization and for the cost-benefit analysis of internet advertising.
The operating company of the Google Analytics tool is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
We use this tool pursuant to art. 6 para. 1 p. 1 lit. f GDPR. Google Analytics uses so-called “cookies”, text files which are stored on the computer of the users and allow to monitor how the users interact with the web pages. The information generated by the cookies concerning the use of the web site, such as
  • browser type/version
  • operating system of the user
  • referrer URL (the previous web page)
  • hostname of the accessing computer (IP address)
  • time of the server request
are transmitted to the server and stored there. This information is used to evaluate your use of the web site, compile reports on web site activities and provide other services related to the use of the web site and of the Internet for marketing purposes and for the user-oriented design of this web site. These data could be transferred to third parties, insofar this is required by law or those third parties process the data on our behalf.
Google adheres to the data protection rules of the “US Privacy Shield” and is registered in the “US Privacy Shield” program of the Department of Commerce of the United States. In addition we have concluded a processing contract for the use of Google Analytics with Google. Thanks to this contract, Google ensures that personal data will be processed in accordance with the data protection rules and that the rights of the persons concerned will be guaranteed.
The user can prevent the saving of cookies by means of a setting in his browser software. However, you should be aware of the fact that in this case it may be impossible to use the full functionality of the web site.
Moreover, we use Google Analytics for the creation of reports based on demographic data and interest-based advertising as well as user data provided by other web sites (e.g. age, gender and interests). These data are not attributable to specific individual visitors and the feature can be disabled at any time in the browser settings.

3b. How to disable Google Analytics
Users can object to the creation of user profiles at any time. For this purpose, it is necessary to download and install a browser add-on, available under the link https://tools.google.com/dlpage/gaoptout?hl=en. This browser add-on uses JavaScript to notify Google Analytics of the fact that data and information concerning the visitor collected via the web pages shall not be transmitted to Google Analytics. Google considers the installation of the browser add-on an opposition. If the IT system of the user is erased, formatted or reinstalled at a later point in time, it will be necessary to reinstall the browser add-on to deactivate Google Analytics. If the user or another person under his responsibility uninstalls or disables the browser add-on, it can be reinstalled or reactivated. As alternative, refer to point 5 to learn how to enable and disable cookies in the different browsers.

We also rely on Google Analytics for the evaluation of double click cookies and on Google Ads for statistical purposes. If you don’t want us to use these tools, you can deactivate them in the browser settings manager (http://www.google.com/settings/ads/onweb/?hl=en).

4. We use the following third party cookies
4a. Google Maps
This web site uses Google Maps API, a map service provided by Google Inc. (“Google”), for the display of an interactive map and the creation of driving directions. The operating company of Google Maps is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
By means of Google Maps, the data concerning your interaction with this web site (including your IP address) could be forwarded to a Google server in the USA and stored there. 4b. Google Tag Manager
We use Google Tag Manager in our web site. Google Tag Manager is an interface provided by Google Inc. which helps us to manage the tags embedded in our web site. Google Tag Manager is a domain without cookies which doesn’t collect or store personal data. Google Tag Manager only ensures the activation of other tags, which in turn possibly could collect data. The Google Tag Manager cannot access these data. If you have set a deactivation at domain level or at cookie level, the deactivation applies to all tracking tags implemented via the Google Tag Manager.

4c. How to disable Google Ads & Google Remarketing / Google Ads
We have embedded Google Ads in our web site. Google Ads is an online advertising platform which allows us to display advertisements in the Google search engine results as well as in the Google advertising network. With Google Ads, we can define specific keywords by means of which the advertisings are displayed in the search engine only when the user recalls keyword-relevant results. In the Google advertising network, the ads are displayed on thematically relevant internet pages on the basis of an automatic algorithm and under consideration of the previously defined keywords.

We use Google Ads for the promotion of our web site by means of interest-based ad targeting in the web pages of third parties and in the results of the Google search engine, as well as for the display of third-party advertisings on our web site.
When you click on a Google banner displayed on the web site of Ekon GmbH, Google stores a conversion cookie in your IT system. To learn more about cookies, please read the above section “What are cookies”. This cookie expires after thirty days and is not used for the personal identification of the user. The conversion cookie gives us the possibility to see if the users visit certain sub-pages of our web site, e.g. a training page in the online shop system. Thanks to the conversion cookie, Google and our website can see if a user clicked on the ad and proceeded to our web page, and if this visit has generated some revenue, for example if the user has completed the course registration procedure or not.
The data and information collected by means of the conversion cookies are used by Google to generate statistics of the web site visits. We use visit statistics to determine the total number of users and the success or failure of the different advertisings, in order to optimize our ads in the future. Neither our company nor other advertising customers of Google Ads obtain any information that can be used to personally identify users. Conversion cookies store personal details such as the web pages you have visited. Therefore, your personal data are forwarded to Google each time you visit our web site.
As explained under point 5, you can opt-out of this at any time by changing your browser settings and block the cookie storage permanently. Configuring this setting in your internet browser, Google will not be able to set conversion cookies in your IT system. Moreover, a cookie already set by Google Ads can be deleted at any time via the internet browser or another software program.
You also have the possibility to object to the display of interest-based advertisings by Google. For this purpose, you must open the link https://www.google.de/settings/ads in your internet browser and configure the required settings.

This web site uses Google Remarketing, a software for the display of interest-based advertisings on our web pages. For this purpose, Google Remarketing uses cookies (see above). 4d. Facebook Pixel
This web site uses Facebook Pixel, a web analysis service developed by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland (“Facebook”) on the legal basis of the overriding legitimate interest (analysis of web site usage). The data may partly be forwarded to the USA. The data transfer to the USA takes place on the basis of the Privacy Shield. When you recall our web site, a software establishes a connection to the Facebook server and a part of the data are sent to the Facebook server in the USA. Furthermore, Facebook Pixel uses cookies for the storage of information about web site users and for the analysis of the interaction of users with the web site. The remarketing function “Custom Audiences” provided by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) has also been integrated in our web site. Thanks to this feature, we can display interest-based advertisings (“Facebook Ads”) when the visitor of our website uses the social network Facebook or opens other web sites which use this feature.
For this marketing function our web site uses the “Facebook Pixel”, a tracking pixel which is embedded in our web pages. When you visit our web site, this tracking pixel establishes a direct connection between your browser and the Facebook server. This way Facebook gets informed about the fact that you have accessed our web site from your terminal. Please notice that we cannot exercise any control over the amount of transferred data and their further use; therefore we would like to inform you about our current knowledge: Thanks to the integration of Facebook Custom Audiences, Facebook gets informed about the fact that you have called up our web site or clicked one of our advertisings. 4e. How to disable Facebook Pixel
In general, you can block the collection of your personal data using the option “Do Not Track” of your web browser. Our web site will recognize the “Do Not Track” signal sent to all web sites by your browser. You can block the collection of your personal data by means of the Facebook Pixel embedded in our web site by deactivating the cookies in your browser, see point 5.

4f. Google reCAPTCHA
We use Google reCAPTCHA, a tool provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) in order to prevent spam.
reCAPTCHA is a free service that protects websites from spam and abuse. It uses advanced risk analysis technologies to distinguish humans from bots. Thanks to the new API, a significant number of valid human users can pass through with ease without solving a CAPTCHA. We use reCAPTCHA to protect our forms.

4g. Pinterest
In order to ensure the most requirements-focused
utilization of our Pinterest campaigns, their ongoing optimization and measure their implementation, pursuant to article 6 para. 1 lit. f) GDPR, we use a Pinterest Tag, a single code snippet developed by Pinterest Inc., 635 High Street, Palo Alto, CA, USA, (“Pinterest”) and embedded in our web site. This tag gives us the possibility to make sure that our Pinterest ads are visible only for the Pinterest users that have shown interest in our initiative. Our Pinterest ads shall match the potential interests of the users and not bother them. On the other hand, this way we can track the actions of the Pinterest users after they have clicked our Pinterest ads. This allows us to analyse the implementation of the respective campaigns for statistical, marketing and billing purposes. The tool processes the following data:
  • device information (e.g. type, brand),
  • operating system of the user (e.g. iOS 11),
  • IP address of the user device,
  • time of the call up of our offer,
  • nature and content of the campaign and
  • reaction to the respective campaign (e.g. clicks on the button)
The collected data are anonymous and do not allow the identification of single users. The data processing for behaviour- and interest-based advertising purposes has to be considered our legitimate interest according to recital 47 of the GDPR. The data are stored for the legal retention period and automatically deleted thereafter.
You should be aware of the fact that f you log in to your Pinterest account after the visit of our web site or if you visit our web site after the login, your data may be stored and processed by Pinterest. Pinterest may associate these data with your Pinterest account and use them for its own advertising purposes.
